HYRD Terms and Conditions

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING.
By clicking “Start My Job Search” or otherwise enrolling in HYRD services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”).
“HYRD,” “we,” “us,” and “our” mean HYRD Technologies Inc. You (“Client,” “you,” “your”) agree these Terms form a binding agreement.
1. Service Description and No Guarantee Disclaimer
HYRD is a done-for-you job application service designed to accelerate your job search by submitting applications on your behalf. We work diligently to identify opportunities matching your qualifications and submit tailored applications to maximize your chances of success. HYRD cannot and does not guarantee job placement, interviews, or employment outcomes. Hiring decisions remain solely with employers, and success depends on factors beyond our control including market conditions, competition, timing, and employer preferences.
2. Application Volume and Targeting Disclaimer
HYRD will make commercially reasonable efforts to submit approximately twenty (20) suitable job applications per week on your behalf, subject to the availability of relevant roles aligned to your qualifications, location, compensation parameters, and search criteria. This is a target, not a guarantee. Weekly totals may be higher or lower depending on market conditions and role availability. We commit to consistent effort, not to a fixed numeric outcome.
3. Independent Job Search and Duplicate Prevention Policy
You may continue to apply independently to roles. To avoid duplication, you must notify HYRD of any roles you apply to yourself.
How to report your applications
Email care@gethyrd.com with: (a) job title, (b) company name, and (c) application date.
Failure to notify may result in duplicate submissions, for which HYRD is not responsible.
4. Client Responsibilities and Communication Policy
You agree to provide complete, accurate, and truthful information for all applications. Any misrepresentation is solely your responsibility, and HYRD bears no liability for consequences arising from false or misleading information.
You must respond to employer communications and interview requests within forty-eight (48) hours. Delays may lead to missed opportunities for which HYRD is not responsible.
You agree to promptly notify HYRD if you accept a position, change your job search status, or need to modify your search parameters.
5. Payment, Refund, and Chargeback Policy
Your onboarding fee is non-refundable once services commence. Services are deemed commenced when HYRD begins resume optimization, market research, account/profile setup, or application preparation, whether or not applications have yet been submitted.
Monthly subscription fees (if applicable) are billed regardless of application volume or outcomes. Refunds are not provided based on lack of interviews, callbacks, or offers, as these outcomes are beyond our control and are not guaranteed.
Chargeback Waiver. By enrolling, you agree not to initiate chargebacks or payment disputes with your bank or provider. All billing disputes must be raised directly with HYRD and resolved under these Terms.
6. Service Limitations and Employer Response Disclaimer
HYRD has no control over employer response rates, timelines, or decisions. Applications may receive no response, delayed review, or rejection. HYRD cannot influence or expedite employer processes or provide insider status updates beyond what employers communicate.
7. Limitation of Liability and Third-Party Disclaimer
HYRD is not liable for missed opportunities due to market timing, platform outages, or other factors. We are not responsible for errors in job postings, employer misrepresentations, or changes in role availability. While we use reasonable efforts to avoid fraudulent listings, we cannot guarantee the legitimacy of every posting; you should exercise caution and independent judgment. HYRD does not negotiate salaries, benefits, or employment terms unless expressly agreed in writing as an additional paid service.
To the maximum extent permitted by law, HYRD’s aggregate liability is limited to the amounts you paid to HYRD in the three (3) months preceding the event giving rise to the claim. In no event will HYRD be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
8. Data Authorization and Account Management Policy
You authorize HYRD to use your personal information, resume, and professional history to create and manage accounts on job platforms, submit applications, and represent you to potential employers.
Credential Handling. Login credentials created by HYRD remain your property. HYRD does not sell or disclose your credentials to third parties. Upon termination, HYRD will transfer credentials to you or delete them at your request, subject to legal/recordkeeping obligations. Once an application is submitted, HYRD cannot retract or delete it from employer systems.
9. Cancellation and Termination
Either party may terminate services with written notice. HYRD will cease submitting new applications upon termination but is not responsible for applications already submitted or in progress. No refunds will be provided for services rendered or billing cycles already paid.
10. Modification of Terms
HYRD may modify these Terms at any time. We will notify you by email, and changes take effect thirty (30) days after notice. Continued use after the effective date constitutes acceptance of the revised Terms.
11. Governing Law; Arbitration; No Class Actions; Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or HYRD’s services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Venue will be Chicago, Illinois (in person or virtual at the arbitrator’s discretion). No class or representative actions are permitted; you and HYRD agree to arbitrate only on an individual basis. You waive any right to a jury trial.

13. Data Privacy and Protection Policy
Data Collection and Use
We collect personal information including your name, contact details, employment history, education, skills, certifications, salary expectations, geographic preferences, and other information you provide during intake or subsequent communications. We use this data to perform our services (resume optimization, job matching, application submission), operate our site, communicate with you, and improve our offerings.
Data Storage and Security
We store personal information on secure, encrypted systems and implement administrative, technical, and physical safeguards designed to protect against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
Data Sharing and Third-Party Access
We share your information with potential employers and job platforms as necessary to submit applications on your behalf. We do not sell or rent your personal information to third parties for marketing purposes. We may share anonymized or aggregated data for analytics, product improvement, or reporting.
Sub-processors and Service Providers
We may use third-party providers (e.g., hosting, analytics, communication tools, job boards) to support our services. These providers are contractually bound to appropriate confidentiality and security obligations.
Data Retention
We retain your personal information for the duration of our service relationship and for a reasonable period thereafter as required for business purposes, legal compliance, or dispute resolution. You may request deletion, subject to legal retention requirements.
Your Data Rights (General)
You may request access to your data, corrections to inaccurate data, deletion (subject to law), and a portable copy of your data, and you may opt-out of non-essential communications. Contact privacy@gethyrd.com to exercise these rights.
Cookies and Tracking
Our website may use cookies and similar technologies for functionality and analytics. You can control cookie settings via your browser preferences.
International Data Transfers
If you are located outside the United States, your information will be transferred to and processed in the U.S., where privacy laws may differ from your jurisdiction.
Data Breach Notification
If a breach is likely to result in a risk to your rights and freedoms, we will notify affected users within 72 hours of discovery and take appropriate remedial action.
Children’s Privacy
HYRD services are not intended for individuals under 18. We do not knowingly collect personal information from minors.

14. California Privacy Rights (CCPA/CPRA)
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):
Right to Know/Access: What categories and specific pieces of personal information we collected, sources, purposes, and categories of third parties to whom information was disclosed.
Right to Delete: Request deletion of personal information we collected from you, subject to statutory exceptions.
Right to Correct: Request correction of inaccurate personal information.
Right to Opt-Out of Sale/Sharing: HYRD does not sell or share personal information as “sell” or “share” are defined by CCPA/CPRA. If that changes, we will provide a “Do Not Sell or Share My Personal Information” mechanism.
Right to Limit Use of Sensitive Personal Information: HYRD does not use Sensitive PI for purposes requiring a limitation link.
Right to Non-Discrimination: We will not discriminate against you for exercising any CCPA/CPRA rights.
Authorized Agent: You may designate an authorized agent to make requests on your behalf.

Email privacy@gethyrd.com (subject: “CCPA Request”) or call our toll-free number (insert number). We will verify your identity consistent with CCPA requirements before fulfilling requests.
15. European Union/UK Privacy Rights (GDPR/UK GDPR)
If you are located in the EU/EEA or UK, HYRD processes your personal data under the GDPR/UK GDPR.

Lawful Bases: (i) Contract performance (providing job search services), (ii) Legitimate interests (service quality, security, analytics), and (iii) Consent (marketing communications where applicable).
Your Rights: Access; rectification; erasure (“right to be forgotten”); restriction; portability; objection; and the right to withdraw consent (where processing is based on consent).
International Transfers: We rely on appropriate safeguards (e.g., Standard Contractual Clauses) for transfers to the U.S.

Supervisory Authority: You may lodge a complaint with your local supervisory authority if you believe our processing violates GDPR/UK GDPR.
16. Electronic Communications, E-Signatures, and Notices
You consent to receive communications electronically. You agree that electronic signatures (e.g., clicking a button, signing via AngelList/other platforms) are legally binding as handwritten signatures. Notices will be sent to the email you provide.
17. Assignment; Severability; Entire Agreement; Survival
You may not assign these Terms without HYRD’s prior written consent. If any provision is held unenforceable, the remaining provisions remain in full force. These Terms, together with any order form or enrollment page, constitute the entire agreement between you and HYRD and supersede prior discussions. Sections intended by their nature to survive (including Payment, Limitation of Liability, Arbitration) survive termination.

By enrolling in HYRD services and clicking “Start My Job Search,” you affirmatively agree to these Terms and Conditions.
